Terms Of Use

 

      • You must be registered with musicianpromote /MusicianPromote.com/MusicianPromote.net to buy or sell through the site.....don’t worry registration is free for both buyers and sellers
      • Individual promos/jobs are currently set at a fixed prices ($5 for level 1 sellers & $10 for level 2  & $15 -$50 for level 3). Level I sellers withdraws are restricted to minimum of $25 withdrawal to thier PayPal account.
      • Payment is taken in advance for all musicianpromote promos/jobs 
      • musicianpromote only pays the seller after delevery or completion and buyers satisfation of the promo/job (including tangible items)(Digital goods are under copyright and are not money not refunded).
      • You may not offer or accept payments for promo/jobs on musicianpromote using any method other than placing an order through musicianpromote.
      • Buyers are granted all rights for the work once delivered, unless otherwise specified by the seller within their job/promo description or as agreed with the buyer.
    • Sellers

      • Posting / Canceling Jobs/Promos Requirements
      • All sellers are required to follow posting requirements
      • MBM may reject ,accept, suspend and review any posting before OR after it's visable on the site. 
      • MBM may edit any instructions or description or title information if deemed inappropriate or does not follow posting requirements,Or unclear to the buyer.
      • Level one and level II sellers are restricted from giving or instructing buyers to communicate with the seller by leaving contact information meaning URLs email addresses phone numbers or any means of outside communication in Job/Promo postings.
      • Level one and level II sellers are restricted from selling  promos or jobs for $5.00.
      • Always post clear instructions, descriptions and and a least your  statement of credentials for the service, item in your promo/job to the buyer. 
      • Only post job/promos services or  items (exact condition: used ,new damaged,scrap for parts or digital goods) that you can fulfill  and within the days of completion you say you can deliver.
      • Sellers are encouraged to ask buyers to post any previous stats,Identification or proof in the sellers instructions before performing work or shipping items to the buyer.
      • Sellers who cannot complete a buyers order on time or does not have the resources or products to finish a buyers order must submit a mutual cancellation to the buyer. If a buyer request repeatedly to cancel the order the seller must honor the mutual cancellation request by the buyer. Buyers are never obligated to complete in order, however buyers are entitled to a full refund credit back to their MusicianPromote account on mutual cancellations.

      • Getting Paid 
      • All orders are handled through musicianpromote will pay sellers for each promo or job upon successful delivery 
      • For each promo sold and successfully delivered the seller’s account will be credited the remanding balance. ($5 minus 20% = $4). 
      • Withdrawing revenues requires having a valid PayPal  account. Please make sure that your PayPal account can receive incoming payments. 
      • Revenues are only made available for withdrawal after a safety clearance period of 14 days. Sellers must then make a withdraw request to have payments sent to their Paypal account. Currently for security reasons, payments are manually processed and sellers will see payments made to their Paypal account within 24 hours after making a withdraw request.
      • PayPal's imposes a fee for withdrawing revenues so the more you withdraw at one time the better.
      • Once funds have been withdrawn from your account they cannot be re credited If an order is cancelled (for any reason), the seller's revenues are returned to the buyer. 
      • If an order is cancelled (for any reason), the seller's revenues are returned to the buyer.
      • Marking orders as completed when it has been verified failure to deliver items,work(s), work done at URL's or services will result in non payment to you,suspension or permanently blocked from MusicianPromote (MBM) and legal action taken In the event the time has passed on the order delivery to withdrawn payments window.
      • Handling orders
      • The seller will be notified by email each time a buyer orders a promo/job.
      • Sellers are required to meet the delivery duration they specified when creating their promo/job. Failing to do so will permit the buyer to cancel the order and can reduce the seller's rating and subsequently sellers accounts can be suspended temporarily. 
      • Sellers ratings are calculated based on feedback received from buyers, number of orders completed/cancelled and deliveries times met. 
      • Both buyers and sellers have the option to cancel an order by agreement. Doing so has no negative effect on either party. If the seller decides to cancel the order this will have a negative effect on their rating.
      • Privacy and guidelines
      • Sellers' and buyers' identities are kept anonymous. To protect your privacy, avoid requesting or providing Email addresses,URLs, Skype/IM usernames or any other personal contact information.
      • All communications, information and files exchange should be performed exclusively through the site using musicianpromote/musicianpromote messaging system.
      • Posting or sending illegal, potentially offensive, abusive, copyright protected, promotional, spam, violent or any harmful things will result in your account being blocked permanently.
      • Deceiving feedback that is deemed as Nicety (negative feedback given in a positive feedback) will be subject to deletion. Any repeated offense will result in account suspention.
      • musicianpromote nor its subsidiaries and affiliates is not responsible for lost or stolen information, files,content and Identification from any other website(s) and services, if you choose to give any user or member(s) on this site your login Information to any thing that requires access.
      • Unethical Practices - Any seller that promotes thier services to outside competitors with in musicianpromote will face penalties and heavy fines at MusicianPromote discretion.
      • Work delivery & communications
      • You are responsible to scan all transferred files for viruses and malware. musicianpromote will not be responsible for any damages which might occur due to site usage, use of content or files transferred.
      • Promoters/Sellers must deliver completed files and/or proof of work using the 'Deliver Completed Work' tab (located in the Order TrackingPage). For late delivery of work or items, You may receive up to 7 email notifications warning you of late delivery, after which your account , all withdraws and jobs/promos will be suspended and subject to MBM for reinstatement and disbursement of payments to you.
      • Once work is delivered, the buyer has three days to respond and file a complaint. After that time, the order will be marked as complete.
      •  In the case that arbitration is required and musicianpromote decision is final.
      • You may not communicate with users directly providing your email,skype,phone number, unrelated marketing/promotional materials or website url's in any private messages,forms and job descriptions. Only project related URL's and files are permitted in conversations or messages.
      • Withdrawing revenues
      • Withdrawing revenues requires having a valid PayPal account. Please make sure that your PayPal account can receive incoming payments.
      • Revenues are only made available for withdrawal after a safety clearance period of 14 days.
      • MusicianPromote charges a withdraw transfer fee amount of 2% of the total withdrawal sum. Withdrawing $50 or more in one go will save you a little cash.
      • Withdrawals are final and cannot be undone. We will not be able to refund or change this process once it has began.
    • Buyers

      • Ordering / Canceling promo/jobs...
      •  Promos/Jobs may be purchased using a Credit Card or PayPal.
      • Once payment is confirmed, your order will be created. The seller will be notified once you have submitted the required information through the order.  
      • If you have more than $5 credit in your musicianpromote account then $5 will be debited from your account as payment rather than from your nominated paypal account.
      • As a buyer, your identity is kept anonymous at all times. To protect your privacy, avoid requesting or providing URLs, Email addresses, Skype/IM usernames ,Simplified code or any other personal contact information. 
      • You may not pay other users directly using their PayPal account. In case you have been asked to use an alternative payment method, please report it immediately to us.  
      • Avoid filing a dispute or reversing a payment through Paypal or your bank. Doing so may get your account blocked. We provide means to settle disputes and also do internal investigations on transactions to insure diliverablity of work,refunds etc.
      • In case of a problem, always try and work things out with your seller. If you need further assistance, contact our customer support.
      • Order cancellations (when eligible) can be done by customer support only up to a period of 10 days from order completion date. We will not be able to cancel or refund orders after that time.
      • Buyers can request a mutual cancellation to a seller on an order for any reason. If a seller withdraws a mutual cancellation and a buyer still want to cancel the order The buyer should contact support team to evaluate the sellers actions.
      • Important
      • When a buyer buys a job which delivers physically, the buyer will be required to provide a shipping address confirm by PayPal; The Seller will be responsible for all shipping  arrangements once the Buyer supplies the shipping address. The Seller must provide a tracking number to the Buyer through the order tracking page here on MBM and the tracking number must be verifiable/trackable online by a Major U.S. or International shipping carrier  in order to be eligible for sellers protection.  musicianpromote does not handle or guarantee shipping, tracking, quality and condition of items or their delivery and shall not be responsible or liable for any damages or other occurrences,problems caused, directly or indirectly, from delivered items and their shipping.
    • General terms 

      • Violation of musicianpromote Terms of Service may get your account permanently blocked.
      • Sellers will be able to withdraw their revenues from blocked accounts after a safety period of 45 to 90 days, depending on block reason, from day of last cleared payment received in their account and subject to musicianpromote approval.
      • musicianpromote reserves the right to put any account on hold or permanently cancel accounts due to misbehavior. Users with accounts on hold will not be able to sell or buy on musicianpromote. 
      • musicianpromote may make changes to its Terms of Service from time to time. When these changes are made, musicianpromote will make a new copy of the Terms of Service available at http://www.musicianpromote/terms_of_service.
      • You must update your MBM account with an active email address in order to receive
        notices from the site. You are responsible for checking your spam box for notices from this site.
      • Any seller who post a job(s) on the MusicianPromote and is part or simulates representation of a company (legal entity) and chooses to sell illegal offerings or bribes is held accountable by said company (legal entity) and the seller and company (legal entity) release MusicianPromote from any and all legal standing of the posted offer(s).
      • Sellers are forbidden to post jobs of a company (legal entity) or simulate representation of a company (legal entity) with out completing and submitting  account verification to MusicianPromote. Failure to to so will result in legal action and suspension of revenues paid to 
        the seller.
         
      • Disputes and Refunds
      • We encourage our buyers and sellers to try and settle conflicts amongst themselves. If for any reason this fails, we are always willing to settle your dispute before taking it up with PayPal or any other merchant gateway. Users can contact musicianpromote customer support department.
      • musicianpromote will refund payments back to the buyers account balance for orders that are "Cancelled" this includes non delivered, unsatisfactory work from sellers,forced cancelled by sellers, Administration cancels,Mutual cancels by buyers & sellers.  The refunds are made available for withdraws to future purchases on musicianpromote. Refunds to buyers Paypal account for physical items confirmed as not shipped to the buyers confirmed address is subject to Paypal's seller & buyer protection terms.
    • Physical items shipping and selling policy procedures

      What we do

      • Listing -MBM will list your item for sale on the site. See the listing and posting policies in this terms of service.
      • Traffic -  MBM will only provide basic traffic to your listing, based on the sites current traffic status. Your listing must be in the proper starting category ( Merchandise). Basic traffic does not guarantee that your listing will be seen or above of other listings. You must purchase a featured listing in order to maximize the exposure of your merchandise.
      • Fees- MBM takes 20% of the listing and shipping price. Please see the Getting Paid section in this terms of service section for more details on our fee structure.

       

      Sellers

      • General - You must have a paypal account in order to be paid for orders. Make sure to set your paypal email address in your account settings.
      • Product availability- You must ensure the items you're selling is in stock for the duration of your job/promo posting to the buyer. You must list items that will only be delivered to the buyer.
      • Tracking- You must provide a tracking number  delivery confirmation or signature confirmation (for items $250 or more) when delivering your product. All tracking numbers must be verifiable online.
      • Shipping & handling time- You must specify in your job/promo posting.  A clear and accurate time when the item will be shipped.
      • Payments for items - You will be paid for items shipped after the 14 day clearance period. This is to ensure that the buyer has received the item, disputes have been cleared and no chargebacks have occurred.
      • Returns- You're required to specify a return policy in your posting and a return address in your communication to the buyer. We encourage you to accept returns because it will help buyers become satisfied with their items. All buyers are responsible for return shipping cost.
      • Photos - You're required to post an accurate picture of your item. It should show whether the item has dents,scratches ,marks or in new condition.
      • Circumventing -You may not solicit or request to the buyers/seller to purchase your item (s) / service outside of MBM. This includes driving buyers/sellers to other competing/indriect competing products,services or sites using URL's,computer code,abbreviated or miss spelling text in documents,images,audio files and video.
      • Job Posting - Each seller is responsible for abiding by any and every U.S. or International laws pertaining to offerings of the job they post. By posting such offense you release MusicianPromote from any and all responsibilities lawfully.

       

      Buyers

      • General - You must provide accurate information to your payment processing merchant. (paypal etc.). Your payment is processed through our gateway PayPal. Your shipping information is sent to the seller through PayPal.
      • Purchasing - You must pay for the item you buy. Make sure you read the items description carefully before you place the order.
      • Disputes - MBM provides extensive details about how to handle our disputes in this terms of service. See this section for details.
      • Circumventing -You may not request to buy an item outside of MBM.
